                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO REZONE A TRACT OF LAND LOCATED AT 8489 EAST
                   BRAINERD ROAD, BEING ON THE NORTHEAST LINE OF
                   EAST BRAINERD ROAD SOUTHEAST OF SHADY REST
                   ROAD, FROM R-1 RESIDENTIAL ZONE AND R-2
                   RESIDENTIAL ZONE TO O-1 OFFICE ZONE, SUBJECT TO
                   CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as
         amended, known as the Zoning Ordinance, be and the same is 
hereby
         amended so as to rezone:
                A tract of land located at 8489 East Brainerd Road,
                being on the northeast line of East Brainerd Road
                southeast of Shady Rest Road.  Lot 2, Irwin
                Estates, as shown by plat of record in plat book
                25, page 104, ROHC; being the property described in
                deed book 3335, page 458, ROHC.  Tax Map No.
                159O-C-27.
               
               
         from R-1 Residential Zone and R-2 Residential Zone to O-1 
Office
         Zone.
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this rezoning 

         shall be subject to the following conditions:
              1.   A landscaped screen on all sides abutting a 
residential
                   zone in accordance with the following standards:
                  
                   a.	A greenbelt planting strip, not less than fifteen
                        (15) feet in width.  Such greenbelt shall be
                        composed of at least:
                       
                        ...  One row of deciduous and evergreen trees,
                             spaced not more than fifteen (15) feet 
apart,
                             at least eight (8) feet tall, and with a
                             minimum trunk diameter of one and one-half 
(1
                             1/2) inches at planting, and
                       
                        ...  One row of shrubs, with a ratio of two
                             deciduous to one evergreen shrub, spaced an 

                             average of five (5) feet apart.  Such 
shrubs
                             shall be a minimum of thirty (30) inches in 

                             height at planting and expected to grow to 
a
                             height of eight (8) feet in three (3) or 
four
                             (4) growing seasons; or
                  
                   b.	Natural vegetation can be retained if it meets the 

                        intent of this section, or supplemented to meet 
the
                        intent of this section.
             
              4.   All existing easements are retained.
        
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage, as
         provided by law.
